Here you will find the complete rules for sub-letting.

AF Bostäder rents out student housing that is intended to be used during a limited period when a person pursues active studies at Lund University. However, if required, following a special application, permission may be granted to sub-let your accommodation for a limited period.

From the Housing List and Rental Conditions

§ 15 Sub-letting requires the approval of AF Bostäder and can only take place under unchanged rental conditions to someone who fulfils the Housing List and Rental Conditions.

Sub-letting

A sub-let always entails that the tenant themself does not continue to live in the accommodation and grants the use of it to the sub-tenant for “independent use”. Should the tenant continue to live in the accommodation, it is instead considered as a lodging relationship.

AF Bostäder’s approval

A sub-let always requires AF Bostäder’s approval. To obtain such approval, the requirements below must always be fulfilled. There is then an individual assessment of the circumstances relating to the specific case.

  • A written application must be submitted at the earliest six (6) months and at the latest 14 days before the sub-let applied for begins.
  • The applicant must have an acceptable reason for the sub-let (see more below).
  • Subletting cannot take place during the first four (4) months of the tenancy (relocation between our residences without interruption is considered a continuation of the ongoing tenancy).
  • A rental relationship cannot conclude with a sub-let.
  • If the tenant does not fulfil the study and membership requirements during the sub-let period, an exemption from these requirements is to have been granted before the application can be assessed.
  • The sub-tenant must fulfil the study and membership requirements. They will keep their queue time during the subletting period. 

Acceptable reasons for sub-letting

Temporary work outside Skåne

Temporary work is considered to be an unbroken period for placement or seasonal employment. Permission may be granted for a sub-let of at least four (4) and up to a total of twelve (12) months. Trainee positions or probationary employment are not considered to be temporary work, regardless of the length of the employment relationship.

Verification
An employment contract and rental agreement must be enclosed with the application that verifies the type and period of employment as well as the applicant’s address during the stay.

Higher education studies outside Skåne

Higher education studies are considered to be each Swedish or international unbroken period of college or university education that in its scope corresponds to the study requirements. Permission may be granted for a sub-let of at least four (4) and up to a total of twelve (12) months. Studies that do not generate credits or corresponding study qualifications abroad are not considered to be higher education studies. These are instead considered as temporary work.

Verification
Admission notification and rental agreement must be enclosed with the application that verifies the type, period and scope of the studies as well as the applicant’s address during the stay.

Extended stay abroad

An extended stay abroad is considered to be an unbroken period spent abroad. Permission may be granted for a sub-let of at least four (4) and up to a total of twelve (12) months.

Verification
Travel documents must be enclosed with the application that verifies the period away as well as the applicant’s address during the stay.

Compulsory military service outside Skåne

Compulsory military service is considered to be basic training within the Swedish Armed Forces. Permission may be granted for a sub-let corresponding to the period of service. Supplementary training, refresher training, home guard assignments, employment within the Swedish Armed Forces or military service abroad are not considered to be compulsory military service.

Verification
The call-up order must be enclosed with the application.

Try cohabitation

In a try cohabitation, one of the parties sub-lets their accommodation in order to try living together for an unbroken period with the other party in their, or their joint, newly obtained accommodation. In a try cohabitation, you are to live together in a marriage-like relationship, and previous cohabitation should not have taken place. Permission may be granted for a sub-let of between four (4) and twelve (12) months.

Requirement for unchanged rental conditions

The basis for a sub-let agreement is that it substantially contains the same rental conditions as the tenant’s contract. This means that the rent normally must not exceed the rent that the tenant pays to AF Bostäder. However, the tenant does have the option to impose a surcharge of up to 15% for furnishing of the accommodation provided that this is not already included in the contract with AF Bostäder. The tenant can also impose a surcharge for electricity if it is not already included in the contract.

Who can be a sub-tenant?

Sub-letting must only be to someone who is on AF Bostäder’s housing list and fulfils our Housing List and Rental Conditions, and who intends to live permanently in the accommodation during the permitted rental period. It is therefore not permitted to sub-let housing for short periods via Air BnB or Blocket.

If the rules are not followed

AF Bostäder will terminate the rental agreements of tenants who do not have permission or who charge an excessively high sub-let rent. It is also a punishable offence. The sub-tenant also has the right to recover the whole excess rent even if the sub-let relationship has already expired. AF Bostäder will also terminate the agreements of tenants who sublet their accommodation for short periods via e.g. Air BnB or Blocket, even if permission has been granted for sub-letting.

AF Bostäder regards any attempt to circumvent the housing list and our Housing List and Rental Conditions as a serious matter. We will therefore respond strongly by terminating tenants’ rental agreements and cancelling the queue time of both the tenant and sub-tenant every time this occurs.

  • Familiarise yourself with our rules so that you do not put your rental agreement at risk and assume a repayment obligation.
  • Submit your application to us in good time.
  • A sub-let is always your responsibility. You are responsible for any disturbances, damage and other offences that the sub-tenant makes you liable for.
  • Always write a rental agreement with the person who is to sub-let.
  • Ensure that the sub-tenant has valid home insurance.
  • Always pay the rent to us yourself.
